ORDER

This order shall dispose an appeal filed by Sh. Ranveer Singh r/o 218, Gomukh Apartments, Kaushambi Ghaziabad, U.P. u/s 19 (1) of the RTI Act 2005 on 17 Oct 2007 regarding his application I.D. 441 under RTI Act. The appeal has been filed stating that “the Information Officer has turned down the request on the ground of insufficient information.”

Perusal of the PIO’s response show that PIO has mentioned that “in the absence of particulars of certificates, address on which issued and date of issue, it would not be possible to furnish the requested information.”

The applicant was called on 29 Oct 2007 when he enclosed a copy of the OBC certificate issued on 27 Aug 2002. The applicant wanted the following information:-

1) Original application alongwith enclosures
2) Proceeding and order of SDM for granting the OBC certificate which the applicant already has.
3) Proceeding and order of the cancellation of the OBC certificate and the relevant further record.
4) All papers and investigation proceedings with respect of the cancellation of OBC certificate.

The SDM concerned was directed to supply the available information who in turn has informed that the OBC certificate was issued as per the entry made in the register but cancellation proceedings and investigation proceedings were not available in the sub-division’s records. On further enquiry it has been observed that in the instant case, the OBC certificate was issued on the basis of wrong information given by the applicant i.e. certificate was issued inadvertently on the basis of the wrong information furnished by the applicant and on the basis of the report given by Sh. Raj Kumar, Baillif who did not reveal the correct facts to the then SDM (Preet Vihar) Sh. A.K. Bisht. In a report sent to the Assistant Commissioner of Police (Anti Forgery Section), Crime Branch on 9 Dec 2004, it has been reported by the then SDM (Preet Vihar) that the process for cancellation of the above mentioned certificate has been initiated. But further inquiries and report of the SDM (Preet Vihar) shows that the process has not been completed. In the absence thereof, there is no information w.r.t. (3) and (4) and thus there is no question of supplying it. All other relevant information is already available with the applicant.


The appeal is accordingly disposed.


Appeal against this order can be made to the Second Appellate Authority i.e. Central Information Commission, Old JNU Campus, Club Building, Delhi-110 067 within 90 days of receipt of this order.
