15.1)  Question:   Provision of law which authorized Govt. of NCT of Delhi to grant license to the NDPL, BSES Yamuna Power Limited and BSES Rajdhani Power Limited.

 

       Answer:   Regarding Point No. 1: Section 20 of Delhi Electricity Reform Act,2000 empowers the Delhi Electricity Regulatory Commission to grant license to the Distribution Companies.

 

 

 

15.2)  Question:   License deed granted by Govt. of NCT of Delhi to the NDPL, BSES Yamuna Power Limited and BSES Rajdhani Power Limited;

 

       Answer:   Regarding Point No. 2: Your application has transferred to DERC.

 

 

 

15.3)  Question:   Mandatory obligations o NDPL, BSES Yamuna Powe Limited and BSES Rajdhani Power Limited towards customers and rights of the customers to avail services;

 

       Answer:   Regarding Point No. 3: In accordance with Section 42(5) of the Electricity Act, 2003, all the three Distribution utilities have set-up their Forums for redressal of consumer grievances and;

Delhi Electricity Regulatory Commission (DERC) has also appointed the Electricity Ombudsman in August, 2004 in compliance with the provisions of Section 42(6) of the Electricity Act, 2003.

 

 

 

15.4)  Question:   Details of public information officers and first appellant authorities appointed by the NDPL, BSES Yamuna Power Limited and BSES Rajdhani Power Limited under the RTI Act, 2005;

 

       Answer:   Regarding Point No. 4: The Distribution Companies were brought under the purview of RTI Act, 2005 by Chief Information Commission (CIC) in the matter of Sh. Sarabjit Roy Vs. DERC vide decision of the Commission dated 16.03.2006. Against the impugned order of the CIC the Distribution Companies have filed Writ Petition Nos. 6833, 6834 & 3835 of 2006 before the Hon’ble High Court of Delhi. The Hon’ble High Court has granted stay on 03.05.2006.

First appeal against the orders of the PIO filed by Shri Jagdish Ambedkar, Managing Trustee, Indigent Police Personnel Sewa Trust.

1 A number of points have been raised in the appeal. The obligations of NDPL, BRPL and BYPL towards customers and rights of the customers to avail services. The factual information on customers redressal system has been provided by the PIO and as far as setting standards for customers is concerned, this is within the jurisdiction of the DERC. The matter needs to be addressed to DERC.

2. The details of the list of Public Information Officers appointed by the NDPL, BRPL and BSES had been sought. However, it was clearified by the PIO that the matter is currently subjudice int he High Court of Delhi which has granted a stay. The factual position of the current litigation was brought to the notice of the applicant and the applicant can get copies of the orders of the High Court.

3. The information relating to law/rules enabling NDPL, BRPL and BSES to deny new electricity connection has to be secured from DERC.

The first appeal hereby disposed off with the above orders.
